WAIVERS OF DEVELOPMENT STANDARDS for the following: 1) reduced setback; and 2) alternative design standards (roof pitch) in conjunction with an existing single family residence on 0.1 acres in an R-1 (Single Family Residential) Zone.
Generally located on the north side of Drift Stone Avenue, the south side of Warm Springs Road, and 150 feet east of Bermuda Road within Paradise. BW/ww/dr
WAIVERS OF DEVELOPMENT STANDARDS:
1. To reduce the rear setback to 13 feet where 20 feet is required (a 35% reduction).
2. To reduce the roof pitch to 1.5:12 where 3:12 is required (a 50% reduction).

The plans depict an existing building addition on the rear of the home, with a stucco exterior and tile roofing to match the principal residence, and the same elevation as the rear of this single story home. The applicant has enclosed the patio cover in order to have a climate controlled place to smoke in the summer, and reduce the traffic noise from Warm Springs Road, which is directly over the rear wall. The applicant states that it was an oversight that building permits were not pulled for this project, and requests that these waiver requests be granted, so that the proper permits may be obtained.
Surrounding Zoning and Land Use
The subject parcel is part of a developed single family residential neighborhood that is zoned R-1, and planned as Residential Suburban. These home sites surround the property on the east, south, and west. To the north across Warm Springs Road are developed parcels zoned M-1, and planned as Business and Design/Research Park.
Clark County Public Response
This application is the result of a zoning violation (ZV-10638-07).
STANDARDS FOR APPROVAL:
The applicant shall demonstrate that the proposed request meets the goals and purposes of Title 30.
While staff does not normally support waiver requests due to the applicant not seeking building permits as required, staff finds that in this case the applicant has built an aesthetically pleasing and architecturally compatible addition to the main residence. The reduction in rear setback is not excessive, and the parcel backs up to a 100 foot wide arterial street (Warm Springs Road). Therefore, there are no neighbors to the rear that are impacted by either the reduced setback or the reduction in roof pitch. In addition, if this structure had remained only a patio cover it would meet setback requirements for this zoning district. As a result, staff can support these waiver requests.
If this request is approved, the Board and/or Commission finds that the application is consistent with the standards and purpose enumerated in the Comprehensive Plan, Title 30, and/or the Nevada Revised Statutes.
