Luxury Professional Business Center - Development Agreement Ordinance

RECOMMENDATION:

That the Board of County Commissioners introduce an ordinance to consider adoption a Development Agreement with Rosario R. Prichard Revocable Living Trust for a commercial development (Luxury Professional Business Center), generally located on the north side of Warm Springs Road and the east side of Gagnier Street within the boundaries of the Town of Spring Valley.

FISCAL IMPACT:

None by this action.

BACKGROUND:

The Board of County Commissioners (Board) approved zone change request, ZC-1933-05 on January 18, 2006 for a future commercial development (Luxury Professional Business Center). Conditions of approval of the zone change included the developer and/or owner entering into a Development Agreement prior to any permits being issued in order to provide their fair-share contribution toward public infrastructure necessary to provide service. Rosario R. Prichard Revocable Living Trust owns approximately 2.5 acres, in the southwest portion of the Las Vegas Valley scheduled for this development.

The ordinance for the Development Agreement with Rosario R. Prichard Revocable Living Trust for the proposed commercial development is scheduled to be introduced to the Board of County Commissioners on August 22, 2007 at the Board of County Commissioners meeting. In accordance with the provisions of Section 278.0203 of the Nevada Revised Statutes, the Development Agreement must be approved by ordinance. Documents are available for review in the Department of Comprehensive Planning, Current Planning Division.

Staff recommends that the Board set a public hearing for September 5, 2007, to consider adoption of the ordinance for the Development Agreement with Rosario R. Prichard Revocable Living Trust for the proposed commercial development.

AN ORDINANCE TO ADOPT THE DEVELOPMENT AGREEMENT WITH ROSARIO R. PRICHARD REVOCABLE LIVING TRUST, WHO OWNS APPROXIMATELY 2.5 ACRES, FOR A COMMERCIAL DEVELOPMENT, GENERALLY LOCATED ON THE NORTH SIDE OF WARM SPRINGS ROAD AND THE EAST SIDE OF GAGNIER STREET BEING THE WEST HALF (W1/2) OF THE SOUTHWEST QUARTER (SW1/4) OF THE SOUTHEAST QUARTER (SE1/4) OF THE SOUTHWEST QUARTER (SW1/4) OF SECTION 4, TOWNSHIP 22 SOUTH, RANGE 60 EAST, WITHIN THE BOUNDARIES OF THE TOWN OF SPRING VALLEY, AND PROVIDING FOR OTHER MATTERS PROPERLY RELATED THERETO.

THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF CLARK, STATE OF NEVADA, DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. In accordance with the provisions of Section 278.0203 of the Nevada Revised Statutes and Chapter 30.20 of the Clark County Code, the Development Agreement with Rosario R. Prichard Revocable Living Trust, who owns approximately 2.5 acres for a commercial development, generally located on the north side of Warm Springs Road and the east side of Gagnier Street being the west half (W1/2) of the southwest quarter (SW1/4) of the southeast quarter (SE1/4) of the southwest quarter (SW1/4) of Section 4, Township 22 South, Range 60 East, within the boundaries of the Town of Spring Valley, is hereby adopted.

SECTION 2. If any section of this ordinance or portion thereof is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such holding shall not invalidate the remaining parts of this ordinance.

SECTION 3. All ordinances, parts of ordinances, chapters, sections, subsections, clauses, phrases or sentences contained in the Clark County Code in conflict herewith are hereby repealed.

SECTION 4. This ordinance shall take effect and be in force from and after its passage and the publication thereof by title only, together with names of the County Commissioners voting for or against its passage, in a newspaper published in and having a general circulation in Clark County, Nevada, at least once a week for a period of two (2) weeks.
