UC-0451-07 NEW YORK-NEW YORK HOTEL & CASINO, LLC:

USE PERMIT for an on-premise consumption of alcohol establishment (bar/tavern) in conjunction with an outside dining and drinking area.

DESIGN REVIEWS for the following: 1) an outside dining and drinking area; 2) outside live entertainment; and 3) a manmade decorative water feature in conjunction with a resort hotel (New York-New York) on 22.0 acres in an H-1 (Limited Resort and Apartment) Zone in the MUD-1 Overlay District.

Generally located on the west side of Las Vegas Boulevard South and the north side of Tropicana Avenue within Paradise. RR/dk/dr

BACKGROUND:

Project Description

The plans depict a tavern with an outside dining and drinking area in conjunction with a night club (Rok Vegas) that replaced the old theater space within the New York-New York Resort Hotel. The outside dining area is 2,846 square feet and will be constructed on a portion of the site between the resort building and the replica of the Brooklyn Bridge which is a private walkway and entrance to various uses within the resort. The dining area features the seating area, an outside bar, and a DJ booth for live music. Several architectural features are incorporated in the project design which includes an 8.5 foot wall with translucent panels, a curved canopy above the bar, a trellis with a mounted projector that will project images onto an existing sign, and an illuminated glass water wall (manmade decorative water feature). The water feature does not include an outside pool area but features an enclosed mechanical piping system that directly funnels the water onto the glass wall, allowing the water to circulate within the feature and therefore reducing the amount of water evaporation.

Prior Land Use Requests

DR-0012-04 was approved in February 2004 for the remodel of outside uses and modifications to sign standards. DR-1858-02 was approved in February 2003 to permit 2 animated signs along Las Vegas Boulevard South and a total signage of 34,336 square feet including a freestanding sign. UC-0886-02 was approved in August 2002 to permit outside retail uses without primary access through the resort as well as several other items. DR-0662-02 was approved by the Board of County Commissioners in June 2002 for additional signs on the resort. UC-0150-02 was approved in March 2002 for a 9/11 Memorial. UC-0133-02 was also approved in March 2002 for additional signage with increased height.

Surrounding Zoning and Land Use

To the north and west are the Monte Carlo Resort Hotel and the Project CityCenter in an H-1 zone. East across Las Vegas Boulevard South is the MGM Grand Resort Hotel in an H-1 zone, and to the south are the Tropicana Resort Hotel and the Excalibur Resort Hotel in an H-1 zone.

STANDARDS FOR APPROVAL:

The applicant shall demonstrate that the proposed request meets the goals and purposes of Title 30.

Analysis

Current Planning

Bars/taverns in conjunction with outside dining and drinking areas for resort hotels along Las Vegas Boulevard South are becoming more common. Staff can support this request because outside taverns and dining areas create a pedestrian friendly environment and enliven the streetscape which are elements encouraged by the Winchester/Paradise Land Use Plan and MUD Overlay Districts along the Strip corridor. Staff can support the manmade decorative water feature because water does not accumulate on the exterior of the feature, thus limiting the evaporation of water.

Staff Recommendation

Approval.

If this request is approved, the Board and/or Commission finds that the application is consistent with the standards and purpose enumerated in the Comprehensive Plan, Title 30, and/or the Nevada Revised Statutes.
