WAIVERS OF DEVELOPMENT STANDARDS FIRST EXTENSION OF TIME to commence the following: 1) permanently reduce on-site parking for an existing development (Jockey Club); and 2) permanently permit off-site parking for the Jockey Club on the Cosmopolitan Resort Hotel site in conjunction with an approved resort hotel (Cosmopolitan) on 8.7 acres in an H-1 (Limited Resort and Apartment) Zone in the MUD-1 Overlay District.

WAIVERS OF DEVELOPMENT STANDARDS:
1. a. To permanently reduce on-site parking for the existing Jockey Club to 358 parking spaces where 649 parking spaces are required per an existing approved Title 29 requirement (a 44.5% reduction).
b. To permanently reduce on-site parking for the existing Jockey Club to 358 parking spaces where 693 parking spaces are required per Title 30 requirements (a 48.3% reduction).
2. To permanently permit 358 off-site parking spaces for the Jockey Club on the Cosmopolitan Resort Hotel site.

The application is a request to reduce parking for the Jockey Club and provide all of the required parking spaces in an off-site location at the Cosmopolitan Resort Hotel. The applicant requests additional time to commence since the off-site parking waiver will take effect when the parking structure for the Cosmopolitan is built. The applicant also indicates that construction of the Cosmopolitan Resort Hotel is at the early stages and anticipates the project to be completed in 3 years.
Prior Land Use Requests
UC-1575-04 was approved by the Board of County Commissioners (BCC) in November 2004 to develop a 53 story, 2,400 room resort hotel (Cosmopolitan). UC-0136-05 was approved in March 2005 to modify the previously approved Cosmopolitan. The original application, WS-0372-05, was approved by the BCC in May 2005 to permanently permit 358 off-site parking spaces for the Jockey Club on the Cosmopolitan Resort Hotel site. WS-1638-05 was approved by the Planning Commission (PC) in December 2005 to allow a temporary reduction in parking during construction subject to signed agreements that cover 90 on-site valet parking spaces and 360 off-site parking spaces at the Planet Hollywood Resort Hotel (formerly the Aladdin) that will be linked to the Jockey Club via shuttle services. The first extension of time, WS-1638-05 (ET-0029-06), was approved by the PC in March 2006 to allow the applicant additional time to submit copies of the signed agreements to the County. The second extension of time, WS-1638-05 (ET-0363-06) was approved by the PC in January 16, 2007. WS-1556-06 was approved by the PC in December 2006 to allow a 32% reduction in on-site parking and modifications to parking design standards for the Cosmopolitan Resort Hotel.
Surrounding Zoning and Land Use
To the east across Las Vegas Boulevard South is the Planet Hollywood Resort Hotel (formerly the Aladdin) in an H-1 zone. To the south across Harmon Avenue and to the west is the site of the approved Project CityCenter in an H-1 zone. To the north are the existing portions of the Jockey Club and Bellagio Resort Hotel in an H-1 zone.
STANDARDS FOR APPROVAL:
The applicant shall demonstrate that the proposed request meets the goals and purposes of Title 30.
Staff can support an extension of 3 years to match the anticipated date of completion of the resort hotel. The parking conditions at the Jockey Club are monitored through WS-1638-05 which is anticipated to continue until the completion of the project.
If this request is approved, the Board and/or Commission finds that the application is consistent with the standards and purpose enumerated in the Comprehensive Plan, Title 30, and/or the Nevada Revised Statutes.
PRELIMINARY STAFF CONDITIONS:
Until May 18, 2010 to commence;
All applicable standard conditions for this application type.
Applicant is advised that any change in circumstances or regulations may be justification for the denial of an extension of time.
