BACKGROUND:

Project Description

The plans depict a proposed convention center building in conjunction with the MGM Grand Resort Hotel. The facility will be located at the center of the MGM site adjacent to the pool complex and the existing convention center. The building is single story, 37 feet high, and 103,000 square feet. Floor plans submitted by the applicant depict an 88,400 square foot exhibition space that can be divided depending on the convention needs. The space where the building is proposed to be constructed is a parking lot that is utilized by MGM for temporary events. The new convention center will not have an impact on parking since the entire development has a surplus of 2,700 parking spaces over what is required. With the addition of the new convention building, 7,784 parking spaces are required for the entire site and 10,484 spaces are provided.

Prior Land Use Requests

UC-0036-07 was approved by the Planning Commission on February 20, 2007 for an outdoor temporary commercial event to exceed the maximum number of days per event.

Surrounding Zoning and Land Use

The property is surrounded by developed H-1 zoned parcels in the resort hotel corridor.

STANDARDS FOR APPROVAL:

The applicant shall demonstrate that the proposed request meets the goals and purposes of Title 30.


Analysis

Current Planning

The new structure will allow the applicant to increase convention space capability and flexibility. Staff can support this application since the building is located at the center of the MGM site, and provided parking exceeds code requirements.

Department of Aviation

The development will penetrate the 100:1 notification airspace surface. Therefore, as required by 14 CFR Part 77, and Section 30.48.120 of the Clark County Unified Development Code, the Federal Aviation Administration (FAA) must be notified of the proposed construction or alteration.

Staff Recommendation

Approval.

If this request is approved, the Board and/or Commission finds that the application is consistent with the standards and purpose enumerated in the Comprehensive Plan, Title 30, and/or the Nevada Revised Statutes.

PRELIMINARY STAFF CONDITIONS:

Current Planning

All applicable standard conditions for this application type.

Applicant is advised that any change in circumstances or regulations may be justification for the denial of an extension of time; and that this application must commence within 2 years of approval date or it will expire.

Civil Engineering

Traffic study and compliance;

Traffic study to also address additional right-of-way dedication for Tropicana Avenue, if required to be coordinated with Nevada Department of Transportation;

Drainage study update and compliance;

Nevada Department of Transportation approval.

Department of Aviation

No building permits shall be released for the project prior to the Department of Aviation notifying Zoning Plan Check that the applicant has received all necessary airspace approvals;

Applicant is required to file a valid FAA Form 7460-1, "Notice of Proposed Construction or Alteration" with the FAA, in accordance with 14 CFR Part 77, or submit to the Director of Aviation a Property Owners Shielding Determination Statement and request written concurrence from the Department of Aviation;

If applicant does not obtain written concurrence to a Property Owner's Shielding Determination Statement, then applicant must also receive either a Permit from the Director of Aviation or a Variance from the Airport Hazard Areas Board of Adjustment (AHABA) prior to construction, as required by Section 30.48 Part B of the Clark County Unified Development Code.

Applicant is advised that the FAA's determination is advisory in nature and does not guarantee that a Director's Permit or an AHABA Variance will be approved.
