USE PERMITS:

2. Reduce the separation between the subject checking business and existing check cashing businesses to approximately 625 feet and 725 feet where a minimum of 1,000 feet is required.

BACKGROUND:
Project Description
The applicant currently occupies a 2,300 square foot lease space under an issued business license for a credit/financial institution, not a check cashing facility. The existing check cashing service named, Las Vegas Cash Advance is within an existing shopping center, which is next to a developed condominium complex located to the south and east of this site. In addition to the reduction of separation from a residential use, there are also 2 existing check cashing businesses located within 1,000 feet of this business to the north and northwest of this site.
Prior Land Use Requests
UC-1573-00 was approved by the Planning Commission in December 2000 for a convenience store within an existing retail center on 1.2 acres.
Surrounding Zoning and Land Use
To the north of this site is undeveloped C-2 zoning. To the south and east is a developed condominium complex zoned R-3 and R-4 and to the west across Jones Boulevard is developed C-1 zoning.
STANDARDS FOR APPROVAL:
The applicant shall demonstrate that the proposed request meets the goals and purposes of Title 30.
Analysis
Current Planning
There are 2 properly licensed check cashing facilities in the vicinity of this request: one is 625 feet to the northwest fronting Jones Boulevard which was approved in August 2004 and the second is 725 feet to the north fronting Flamingo Road, which was licensed as a check cashing facility prior to this business. Even though this facility has been in operation since 2003, the correct business license should have been requested at that time if the actual business operation is check cashing and is named, Las Vegas Cash Advance. The applicant is now dealing with separation issues after the fact that the business in operation. The intent of the check cashing requirement portion of Title 30 is to prevent a concentration of such businesses in any given area, as well as maintaining appropriate separations to residential areas. Staff cannot support this request as this use would further cause a proliferation of check cashing facilities in the area.
Staff Recommendation
Denial.
If this request is approved, the Board and/or Commission finds that the application is consistent with the standards and purpose enumerated in the Comprehensive Plan, Title 30, and/or the Nevada Revised Statutes.

If approved, subject to all applicable standard conditions for this application type. Applicant is advised that any change in circumstances or regulations may be justification for the denial of an extension of time; and that this application must commence within 2 years of approval date or it will expire.
